Abstract

Fishing in Islam depends on intention, in carrying out an activity it has a very important role in the quality of an action carried out by a person. If an action is good, if the intention is bad, then the quality of the action becomes bad and the perpetrator even sins. Likewise, if the action is good but the intention is only to obtain certain satisfaction because of his hobby, then he only gets satisfaction according to his motive and may not get a reward (in vain). -drain). The aim of this research is to find out whether the system implemented in Alva's fishing business is in accordance with existing Islamic law. This type of research is qualitative, which aims to understand a phenomenon experienced by the subject such as behavior, perception, motivation, action, etc. In qualitative research, data sources are collected through various methods, such as the results of interviews, observations, or documents which are previously processed for further analysis to obtain results and conclusions. Based on the results of the analysis carried out by researchers, it can be concluded that Alva's fishing business transactions are not in accordance with Islamic law. The system applied is social gathering and galatama. The contract carried out is included in the Tijarah contract because it aims to gain profit (profit). The implementation of the contract in both systems contains elements of gharar because of the uncertainty in the number of fish obtained. In the social gathering system there is gharar (unclarity) and uncertainty regarding the acquisition of fish (according to the catch), while the entrance ticket price paid is the same. The Galatama system also contains elements of gharar and maysir. Galatama, which is packaged in the form of a competition that is similar to gambling, contains elements of maysir in it so that it can benefit one party and harm the other party.
