Abstract
In the era of globalization, technology is developing so rapidly, especially internet technology. Currently, various kinds of applications have been created, one of them is Instagram which is an application for communicating with each other or sharing content in the form of writings, photos, videos, etc. Besides the convenience, there are also negative impacts, one of them is the rampant of online gambling. Especially on Instagram application which gives people freedom of expression, and online gambling transactions supported by related advertisements make many people tempted. From that there’s question of how effective legal protection and policies related to online gambling are, considering that online gambling is still so rampant. This research uses normative legal research methods with a normative juridical approach. This research aims to find out the form of legal protection of electronic systems on the Instagram application for online gambling advertisements and knowing government policies in overcoming online gambling content circulating on the Instagram application. The results showed that legal protection of online gambling has been regulated in Article 27 Paragraph (2) of the ITE Law, the PSTE Government Regulation, and the Regulation of the Minister of Private PSE, beside that, the Indonesian government through Kominfo cooperates with Instagram and other related parties to block online gambling advertisements. The government policy in overcoming online gambling advertisements circulating on Instagram is contained in Article 27 paragraph 2 of the ITE Law, the PSTE Government Regulation, and the Minister of Private PSE Regulation Article 13 and Article 15, and the government has taken several actions in the form of blocking sites; cooperation with Instagram platforms; supervision and monitoring; law enforcement; education and socialization; and development of technological infrastructure.
