Abstract
Photographic works are works that are exclusively protected under the Copyright Act. What is meant by photographic works includes all photos produced using a camera, one of which is product marketing photos. Copyright infringement of photographic works occurs when photographic works made using cameras as well as efforts and ideas to improve product promotion photos and if the creator feels that his own photographic work is used, published, and reproduced by someone without prior permission and does not include the original name of the creator of the photographic work. The research used in this study is a normative juridical approach. The results showed that the legal consequences are subject to criminal sanctions in accordance with Article 113 paragraph (3) of Law No. 28 of 2014 concerning Copyright. Affiliators as creators/holders of copyrighted works of product promotion photography can file a civil lawsuit in the form of compensation. The Copyright Act has provided legal protection to the authority owned by affiliators as creators / holders of copyrighted photographic works. Forms of protection against the creator of an infringement of copyright owned can be in the form of preventive and repressive efforts. Both efforts to enforce legal protection for infringement of copyright are still encountering obstacles due to weak efforts made by law enforcement and lack of socialization of UUHC to copyright holders.
