Abstract

The concept of judicial independence that judges carry is always associated with accountability as a means of openness to receiving criticism and control from outside and a sense of responsibility. Legal rules as a juridical and moral foundation for law enforcement and justice reflect the national legal system, even in the context of National Development and National Legal Development, then this is what can be called "Law Enforcement in Indonesia". The freedom of judges in adjudicating criminal cases that aims to produce fair and acceptable decisions to the community needs to be protected, so that there is no intervention of power and interests. Decisions made with a rational basis of objective legal argumentation and strong ethical and moral content can be accountable to justice-seeking communities. Legal guarantees for the freedom of judges in carrying out judicial duties are regulated in the Constitution and laws. The regulation of the freedom of judges in adjudicating is also regulated in international conventions, guaranteeing the freedom of judges in adjudicating and immunity from all legal demands. Legal guarantees for objective and fair freedom of judges in adjudicating are very important to maintain public trust in the judicial system in Indonesia. In addition, this abstract also discusses the importance of implementing principles in trials, such as the principle of open trials for the public, the principle of justice, the principle of communication with direct questioning and the principle of evidence. These principles are very important to maintain justice in trials and guarantee human rights.
