Abstract

This research aims to determine consumer protection against illegal traditional medicines containing medicinal chemicals (BKO) based on the enactment of Law Number 8 of 1999 concerning Consumer Protection. The issues discussed are: 1. The legal basis that regulates the circulation of illegal traditional medicines containing Medicinal Chemicals (BKO) 2. Legal protection for consumers regarding the circulation of illegal traditional medicines containing Medicinal Chemicals (BKO). This research method is juridical-normative in nature so that normative legal research can use law as the only guideline for assessing whether an event is true or not. This research produces: 1. The substance of statutory regulations regulates supervision and sanctions given to the distribution of traditional medicines containing BKO. Law Number 8 of 1999 concerning Consumer Protection explains that consumers who have been harmed can take legal action by reporting the businessman concerned using accurate evidence. 2. The government has a big role in the distribution of traditional medicines containing BKO. In Indonesia, there are still cases of the use of BKO in traditional medicine which proves that law enforcement with the threat of prison and fines does not have a deterrent effect on business actors.
