Abstract

Cases of sexual violence against female victims in Indonesia still often occur, including victims with disabilities, however, the handling of disabled victims has many shortcomings due to various factors. The Indonesian state has guaranteed the protection of the rights of citizens, both healthy and disabled, through various regulations. However, special regulations regarding criminal acts involving female victims with disabilities do not yet exist and only refer to Law Number 12 of 2022 concerning Crimes of Sexual Violence. Therefore, this research focuses on how cases of sexual violence against female victims with disabilities are handled, including the obstacles to handling them, the solutions found, as well as Islamic views regarding sexual violence against people with disabilities. The aim of this research is to find out what the obstacles and solutions are for female victims with disabilities and what Islamic views are regarding sexual harassment against people with disabilities. The method used in this research is an empirical juridical method, namely searching for data in the field using interview techniques with officers/law enforcers in cases of sexual violence against people with disabilities and also organizations that handle sexual violence against people with disabilities. This research resulted in obstacles that arise in treatment caused by psychological factors, namely the victim's weak thinking ability in facing investigations as well as external factors in the form of interventions that arise from the environment around the victim. The solution to this problem is delaying the examination time, providing companions, props and safe houses (facilities). Furthermore, according to the Islamic view, all humans have equal status and it is prohibited to abuse women (including people with disabilities). Keywords: Disability, Violence, Sexual
