Abstract

This research aims to examine the liability of industrial companies related to alleged environmental pollution in civil law decisions and the role of the Environmental Agency. The researcher evaluates by referring to the Sukoharjo District Court Decision with case number: 29/pdt.G/2023/PN.Skh. This research method uses normative/doctrinal legal research. In this study, it is concluded that the Environmental Agency no longer has authority over alleged environmental pollution by industrial companies based on the new law, namely Law Number 6 of 2023 which is a government regulation replacing Law Number 2 of 2022 concerning Job Creation because it has received administrative sanctions by the Minister of the Ministry of Environment and Forestry and the Sukoharjo Regent twice. So that the industrial company was criminally charged in criminal case number: 152/pid.B/LH/2023/PN.Skh, the Sukoharjo District Court's criminal verdict was determined, but not in accordance with what the residents wanted. the residents filed a Class Action Lawsuit to the Sukoharjo District Court. The verdict of the Sukoharjo District Court Number: 29/pdt.G/2023/PN.Skh rejected the entire lawsuit.
