Abstract

This research aims to examine the application of witnesses' rights to obtain transportation costs in the process of investigations and court hearings. This research uses sociological methods, sociological legal research is research on the effectiveness of law in force in society or research on legal identification using the case study method which uses the types and sources of legal materials used, namely primary, secondary and tertiary legal materials related to legal issues being studied. The data is processed using data analysis techniques with the data analysis method used is the qualitative analysis method. The data obtained, both primary and secondary data, was then collected. Then the data is analyzed with data from research results in the field so that there will be conformity or contradiction to answer the main problem and try to draw conclusions. From this research, the results obtained show that witnesses or experts who have attended a summons to provide information at all levels of examination are entitled to reimbursement of costs according to the applicable laws and regulations. Reimbursement of transportation costs for witnesses has been budgeted by each work unit. The budget provided is guaranteed to be sufficient even though there is no reserve budget because if the budget is not sufficient then a budget revision will be carried out. Threat of criminal penalties for people who refuse to be summoned as witnesses.
