Abstract
Some people engage in benefiting from used items discarded by others and such; they pick from the trash what can be used for sale, possession, or recycling to be used again. A scavenger may pick up something valuable without knowing whether its owner abandoned it, threw it away mistakenly, or forgot it. Thus, from these situations arose a question regarding the ruling on benefiting from these items. A Muslim is only permitted to benefit from what has been stripped from elements of prohibitions and suspicions. Therefore, the researcher here intends to discuss the ruling on scavenging trash considering the rulings of scavenging according to Shafi'i jurisprudence and Indonesian law, then comparing it with Indonesian law to understand the percentage of similarity and difference between them. The researcher will address the following in this study: Is trash considered respectable property? What is the ruling on scavenging it from the perspective of scavenging rulings in Shafi'i jurisprudence and Indonesian law? What are the similarities and differences in the ruling on scavenging trash? This study is of a qualitative nature using a descriptive-analytical and comparative approach. Among the most important findings of this study: All types of trash fall under the definition of property according to some Shafi'i scholars and the Indonesian Great Dictionary. The ruling on scavenging trash according to Shafi'i jurisprudence and Indonesian law is permissible, but it must be determined if the trash has significant value and its owner has abandoned it according to Shafi'i jurisprudence. There are some similarities and differences between them in the ruling on scavenging trash.
