Abstract

Criminal justice is an effort to prosecute the actions of irresponsible business actors. When making a decision, judges use two categories in making legal considerations, namely juridical considerations and non-juridical considerations. The decision given by the judge must consider the moral angle of the sense of justice in society. Such is the case with the decision handed down by the judge against illegal cosmetic business actors who were considered to be very disturbing to the public because they had produced cosmetics without a distribution permit. This research aims to describe the legal considerations of the judge in examining and deciding Case Number 13/Pid.Sus/2020/PN Skh concerning Illegal Cosmetic Soap Products at the Sukoharjo District Court. The author uses normative juridical research methods with a doctrinal approach. The specifics of this research use a descriptive study type with secondary data obtained from a literature review in the form of a decision in Case Number 13/Pid.Sus/2020/PN Skh. The author uses data collection methods with literature study. The results of this research show that the judge's legal considerations in Case Number 13/Pid.Sus/2020/PN Skh concerning illegal cosmetic soap are in accordance with Article 197 in conjunction with Article 106 paragraph (1) of Republic of Indonesia Law Number 36 of 2009 concerning Health, Decision Number 140/Pid.Sus/2017/PN Gin, as well as opinions from Sudarto, Simons, and Zevenbregen.
