Abstract

This research aims to analize. the application to criminal sanctions applied and the judge's considerations in criminal acts of sexual abuse committed by the biological father. The research method uses a case study approach (case approach) with a focus on analysis of decision cases 127/Pid.Sus/2018/PN.Krg. The Data is sources from primary, secondary, and tertiary data. Data collection method through literature study then data analyzed descriptively. The results of the research concluded that the judge at the district court decided to impose a sentence against the defendant in the case of the criminal act of molesting a biological child based on Article 81 Paragraph (3). Law number 35 of 2014 concerning Child Protection. In this decision, the defendant was sentenced to prison for 10 years.
