Abstract
Procurement of land for development in the public interest is a demand that cannot be avoided by any government. The more advanced society becomes, the more land is needed for public (lay) purposes. Development of public interests is one of the government's initiatives in realizing the economic welfare of the people. The definition of compensation is the provision of compensation for losses suffered by land rights holders due to the transfer of those rights. This type of research in legal writing is empirical juridical legal research. The nature of the research used in this research is descriptive. The research approach used by the author is a qualitative approach. The research uses interview techniques or indepht interviews. In this legal writing analysis technique, the author uses qualitative descriptive techniques. The mechanism for providing compensation for toll road construction includes: notification of land affected by the toll road, socialization from the government, land data collection and measurements, deliberation between the community and the toll road team, survey from the appraisal team, release of the amount of compensation, disbursement of funds. The problem when carrying out toll road construction is the assessment of different compensation results. Provision of damages ensures that the rights of parties affected by toll road construction must be open. Government supervision must ensure that compensation is carried out fairly, ensuring that the affected parties receive compensation in accordance with the initial agreement. Injustice in providing compensation, injustice often occurs in providing compensation, where the affected party does not receive compensation in accordance with the losses suffered.
