Abstract
In household life, especially financially, it is known as joint property, but there is no strict rule or legal basis regarding this matter. By expanding the understanding of the juridical review of Articles 35, 36, and 37 of Law Number 1 of 1974 concerning marriage and Article 1 letter (f) of the Compilation of Islamic Law concerning joint property. The analysis focused on the Constateur, Qualifier, and Constituent stages in the context of the division of joint property in Supreme Court Decision Number 503 K/Ag/2022. The library research method was applied using data sources in the form of journals and archives. The research findings indicate the existence of disparities in legal norms, both in the law and the compilation of Islamic law. The analysis was conducted through three stages of the judge's decision, namely constatir, qualifier, and constituent. The Cassation Court judges determined the division of assets, namely 2/5 or 40% for the plaintiff, and 3/5 or 60% for the defendant. The decision-making approach by the Panel of Judges focuses on context and considers normative, social, and moral philosophical aspects in order to achieve overall justice. The legal discovery approach is applied when the legal rules do not show clarity or there are differences in interpretation, providing flexibility for judges in making decisions according to the context of the case at hand.
