Abstract
This study analyzes the reasons why judges delegate custody to male parents, contrary to the Compilation of Islamic Law Article 105 which gives custody to female parents. The purpose of the research is to find out the juridical provisions of custody of minors due to divorce in accordance with Law Number 23 of 2002 and analyze the legal considerations of judges in the Klaten Religious Court Decision Number 0918/Pdt.G/2023/PA.Klt. Descriptive research methods are used with sociological, historical, anthropological, normative, linguistic, and philosophical approaches. The case study highlights the role of Law No. 23/2002 and the Compilation of Islamic Law in post-divorce child maintenance. The child custody agreement of (GNAF) confirms the Defendant's rights without prejudice to the Plaintiff's responsibilities as a mother, in line with Supreme Court Jurisprudence. This agreement reflects the legal commitment of both parties to the harmonious life of (GNAF). The Klaten Religious Court decision affirms the principle of the interests of the child, supporting the values of Indonesian and Islamic positive law. Suggestions involve increasing mediation awareness, legal education, and Islamic teachings in the community, emphasizing the importance of understanding post-divorce rights and obligations holistically.
