Abstract

It is a violation of the Copyright Act to show World Cup matches in commercial areas without permission from the owner of the broadcasting rights. One case of copyright license infringement is in Decision Number 3/PDT.SUS-HKI/2018/PN.SMG. This study aims to determine the form of legal protection given to broadcasting rights license holders for the restoration of broadcasts without permission based on Indonesian law and also to find out the legal remedies that can be taken by broadcasting rights licensees for returning broadcasts without permission. The research method used in this study is the juridical- normative approach, using secondary data types, qualitative analytical methods and deductive behavior. The result of this research is that the legal protection given to the plaintiff, in this case, is by the provisions of the Copyright Act. Legal protection is divided into two forms, namely preventive and repressive legal protection. Legal remedies that can be taken by broadcasting rights holders for confiscation without permission include efforts to resolve disputes, namely through alternative dispute resolution, arbitration or court. In addition, the owner of the broadcasting rights can apply for cassation against the decision of the Commercial Court.
