Abstract

The payment of educational development is the result of an agreement note from the deliberation conducted by the school and parents at Madrasah Tsanawiyyah 2 Muhammadiyah Karanganyar before the new academic year. Therefore, knowledge is needed about the contracts in the payment of educational development that are used as a deep clarification regarding the type of contract. As well as the influence of socio-economic factors that cause other types of payments such as installments or cash in one payment from several transactions. Then it can be seen whether or not it can be done through the perspective of Islamic law on it, to be explained in depth through the arguments of the Quran and Sunnah and the opinions of scholars. Because there has been no research on this, this will be the first for schools to be more comfortable in making payments with contracts according to sharia. This research is a qualitative research with a normative Islamic law approach. In the payment of educational development, there are three contracts, namely the purchase of uniforms and LKS as a sale and purchase contract, IROT as an ijarah ala al a’māl contract, and mandatory savings as a wadiah yad adh dhamanah contract. There is also an installment system that combines the three contracts above so that a multi-contract of al-Uqûd al-Mujtami’ah al-Mukhtalifah type arises because it has two or more different contracts that are combined but not contradictory. According to the view of Islamic law, muamalah contracts such as buying and selling, ijarah, and wadiah do not violate sharia because there is no indication of fraud or gharar, monopoly of buying and selling that leads to coercion, or usury in the transaction. So the payment of educational development is lawful or permissible, because it is in accordance with the principles of mu’āmalah asy-syar’iyyah.
