Abstract
One of the guarantees that is often guaranteed by the debtor to the Sapta Usaha Mulya Savings and Loans Cooperative is in the form of a Certificate of Ownership (SHM) for land ownership. The collateral can be executed in the event of bad credit and can be returned when a debtor has paid off his debt at the time agreed with the Sapta Usaha Mulya Savings and Loans Cooperative. The research method used in this study is empirical juridical where researchers collect data directly from the Sapta Usaha Mulya Savings and Loans Cooperative. The research results obtained that the letter contained in Article 1320 of the Civil Code, and it can be concluded that the terms of the Loan Agreement with Number 1804 / KSP / M / I / 2022 have fulfilled the legal requirements of the agreement in accordance with Article 1320 of the Civil Code. That legal remedies that can be taken by the parties in the Loan Agreement Number 1804 / KSP / M / I / 2022 if the debtor defaults. The creditor cannot carry out parate execution because the object that is pledged as collateral is in the form of a certificate of ownership cannot be registered with the mortgage right stated in Law Number 4 of 1996
