Abstract
Humans are living beings who have broad and fast mobility. Nowadays it's easy to travel anywhere because of the help of technology. Shopee, as the largest online shopping application and it can be said that the online shopping market holder is currently also launching its innovation called shopeefood. This research uses a type of normative approach with library research collection techniques using secondary and primary legal materials. The results of research on the use of fake GPS which are reviewed from the perspective of positive law are that these actions are included in the Law on Information and Electronic Transactions, which are included in Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2018 concerning Information and Electronics. Article 35 article 51 paragraph (1) of the Electronic Transaction Law carries a threat of 12 years in prison and a fine of 12 billion rupiah. And according to Islamic view the use of fake GPS brings more harm than benefit because the use of fake GPS contains more losses than advantages. The parties who experience this loss are consumers, other Shopee drivers. the use of fake GPS includes acts whose purpose is damage and tyranny which are nothing but illegal things and may not be carried out in an act of buying and selling and also drivers knowingly using fake GPS are clearly strictly prohibited.
