Abstract
Legislation is needed in the housing development process, to serve as a legal basis, directives, policies and guidelines for implementing housing as well as resolving conflicts, disputes and cases in the housing sector. The view of Islamic law regarding the system or method of buying and selling, considering that in the buying and selling system there is the use of a mortgage system or home ownership credit and some are without a mortgage system. In buying and selling houses or land, the object is the right to the house and land being sold and not the house or land but the land and house rights. The purpose of this research is to find out the review of Islamic law regarding buying and selling houses with a mortgage system and without mortgages (case studies at PT. Menara Hijau Jaya and PT. Mantos Tri Jaya). The research method used by the author is the approach method used in this study, namely empirical, The results of this study are: The contract applied by PT. Menara Hijau Jaya is a murabaha contract, namely a contract that is carried out using buying and selling instruments by taking profits. Moreover PT. Menara Hijau Jaya cooperates with Bank BTN Solo in carrying out buying and selling of houses and implementing a sharia-based mortgage system. Then PT. Mantos Tri Jaya implements 2 (two) contracts in its implementation, namely the murabahah contract which is more or less the same as PT. Menara Hijau Jaya and istishna contracts, namely sale and purchase contracts in the form of ordering the manufacture of certain goods with certain criteria and conditions agreed between the buyer (orderer) and the seller (manufacturer) and are formed at a certain time.
