Abstract
Protecting the right to privacy means protecting the right to freedom of expression. In other words, the right to privacy secures protection against the fear of doing or not doing something that is a human right. In 2022 Indonesia is being intensified by hacking personal data by a hacker named Bjorka. This data breach is very prone to misuse which will later lead to various crimes such as identity deprivation and fraud. The type of research used is normative research using a legal and conceptual approach. The data collection method used is library research. The results of the study show that: (1) The form of legal protection against misappropriation of personal data on social media is regulated in the ITE Law contained in Article 26. In paragraph 1, article 26 explains that personal data can only be used with the consent of the data owner, explanation of Article 26 (1) emphasized that the protection of personal data is part of the right to privacy. (2) Legal settlement efforts that can be made by a person when his personal data is misused can report/file a lawsuit for the act using the article in the ITE Law along with the evidence. The perpetrator's actions include actions that are prohibited in Article 27 Paragraph 3 of the ITE Law in accordance with criminal provisions, subject to a maximum imprisonment of 6 years and a maximum fine of 1 billion rupiah.
