Abstract

Islam came as a complete and comprehensive religion with instructions and explanations in all aspects of life, including in the Muamalat chapter. In Fiqh Muamalah, the original law of a transaction is permissible. Some people misunderstand this rule and think that everything in the Muamalat chapter is halal without restrictions. They do not see that in fact there is a rule "The Law of Prohibition is Haram," until there is evidence showing that it is permissible. This rule and its application are widely found and spread in the books of scholars, both in worship and muamalah. However, the discussion of these principles in the Muamalat chapter as a separate article is insufficient and sufficient. So that there are many violations of this rule in the Muamalat chapter. This study aims to explain the meaning of this rule and its application in the Muamalat chapter. This paper is a qualitative literature research, by examining books and scientific writings related to this topic. The most important results of this study are: (1) Scholars differ in opinion whether the original law of prohibition is haram or makruh, while the majority of scholars are of the view that the original law of prohibition is haram, does not move to another meaning unless there is a distraction or indication, (2) their difference is due to the word al- nahyu has many meanings, including haram and makruh, (3) The hadiths which contain the sentence al-nahyu in this study all mean haram, except for one hadith which means makruh, namely the hadith about cupping.
