Abstract
Marriage aims to obey God's commandments and form a happy and eternal family and to realize a household life that is sakinah, mawadah, and rahmah. However, the journey of a marriage does not always run harmoniously. Married life is always faced with a problem as a test. Currently, there are many divorce cases with different causes, one of which is divorce caused by one of the parties apostatizing which results in the division of joint property. In this case, whether this religious conversion will be a consideration in the division of the joint property. This research is a normative legal research using primary and secondary legal materials presented in descriptive form. The results of the study found that in Islamic law the division of joint property is divided equally between the former husband and former wife. The breakup of marriage because one of the parties changes religion (apostasy) does not make the division of common property different. Settlement of joint property that does not find a middle ground in deliberation can be submitted to the religious court to obtain a decision of the panel of judges that has legal force.
