Abstract

The development of digital technology not only makes it easy to carry out activities effectively and quickly in almost all areas of life but also has a negative impact in the form of crimes that threaten personal data. Regulations regarding the protection of personal data previously existed in Indonesia, but these policies were still partial and sectoral. Therefore, in order to provide legal certainty and create a sense of security, the Government of the Republic of Indonesia began drafting a special law governing Personal Data Protection (PDP). In its formation, the PDP Law had a criminal law policy, based on the opinion of Satjipto Raharjo, which basically stated that law enforcement is good or bad, one of which depends on how the legal policy is determined, the author is interested in researching how the criminal law policies are contained in the PDP Law and harmonization of these policies with laws that have similar policies. The type of research that the author uses is descriptive analytical research with a normative juridical approach. The results of the study show that the criminal law policy in the PDP Law includes determining criminal acts which include actions in the process of collecting, disclosing, using and falsifying personal data, criminal responsibility can be imposed on humans and legal entities with intentional mistakes, as well as sanctions in the form of imprisonment and fines. Against corporations the heaviest criminal sanction that can be imposed is the dissolution of the corporation. Meanwhile, seen from the harmonization of laws and regulations, the PDP Law is still not harmonious.
