Abstract

The Football Association (FA), as the organizer and responsible for the Premier League, cooperates with Mola TV, where Mola TV is the party that holds the exclusive rights to broadcast Premier League matches for the territory of Indonesia and Timor Leste, then Mola TV feels aggrieved over broadcast without permission through sites on the internet that have published Premier League matches by streaming, as for the types of violations against showing matches via internet sites, these sites can display links to Premier League matches without permission (illegal) from broadcasting matches that are outside the country, for example broadcasting originating from the Middle East, Mola TV finally reported to the authorities for the violation of the broadcasting rights. So that this study has the aim of knowing and explaining the analysis of the Bandung District Court Decision Number 421/Pid.Sus/2020/PN.Bdg on legal protection for English Premier League broadcasting rights license holders for publication without permission through the internet network according to law no. 28 of 2014 concerning Copyright and Knowing the Government's Efforts to Protect Broadcasting Rights License Holders in Indonesia. The normative approach method is used to examine legal aspects, legal principles of the rule of law related to the broadcasting rights license for the English Premier League by Mola Tv. The type of research used is descriptive in nature because it describes and analyzes in a structured and comprehensive manner the broadcasting rights licensing regulations in Indonesia. The results of the research are that Ade Eris is legally proven not to have a license from PT. Global Media Visual and has also violated Article 25 paragraph (2) so that the act was threatened and sentenced according to Article 118 paragraph (2) of Law No. 28 of 2014 concerning Copyright so that he was sentenced to imprisonment for 4 (four) years accompanied by a fine of Rp. 750 000,000.00. (seven hundred and fifty million rupiah). The government is obliged to accommodate legal protection for rights owners through law number 28 of 2014 concerning copyright. The government is an apparatus that is one of the essential factors or components in the realization of law enforcement against copyright infringement, listed in Article 54 of the Copyright Law confirming that the government has the authority to carry out supervision with specific aims to prevent violations of copyrighted content or information in information technology and communication.
