Abstract
Research takes a case about the rise of cases of illegal online loans. Online loans are starting to happen a lot due to Covid-19 that has hit the world. In addition, technological advances are also the cause of the large number of outstanding online loans. The most common cases are the emergence of interest that is beyond the limit and also the billing system by debt collectors who are notorious, making people nervous. This study aims to find out how the OJK supervision system and review of Islamic law regarding the circulation of this online loan. Apart from that, is the OJK supervision system in line with the Islamic legal system as stipulated in the MUI fatwa? The type in this research is normative legal research because what is studied is legal principles, legal principles to find out the OJK supervisory system and views of Islamic law. The results of his research are that OJK has issued rules for online loans, namely POJK No. 77/POJK.01/2016 concerning information technology-based lending and borrowing services. This is an effort to provide legal guarantees to service providers and users. Meanwhile, in Islamic law, the MUI issued a DSN-MUI Fatwa Number 96/DSN-MUI/IV/2015 concerning Sharia Hedging Transactions (al-Tahawwuth al-Islami/Islamic Hedging) on Exchange Rates. In addition, the principle of peer to peer lending must also be based on maqashid sharia, namely Hifdzu mal. If a peer to peer lending company can implement Hifdzu mal then Islam will give permission for the peer to peer lending company to operate in society.
