Abstract

One of the obligations of post-divorce parents is to maintain, protect, educate and care for children to adulthood. The acquisition of child custody that falls to the mother or father is decided by the judge. The granting of child custody in decision number 0221/Pdt.G/2017/PA.Ska falls on the mother where in the decision, the mother is more capable of handling her child than the father. As well as the consideration of deciding that minors (hadhanah) are the rights of their mothers (article 105 letter a in conjunction with article 156 letter a Compilation of Islamic Law). secondary law.
