Abstract

Kleptomania is a mental disorder that causes the sufferer to be unable to stop himself from taking something that does not belong to him. Items stolen by people with kleptomania are usually of little material value. Someone who suffers from kleptomania tends to steal something because of an irresistible urge in him that if he doesn't do it he will feel depressed. Kleptomania can occur not only in adults, but also in children. In this regard, this study examines how criminal responsibility for children with kleptomania tendencies as perpetrators of theft is and also how to resolve criminal cases of theft in children with kleptomania tendencies, especially in Surakarta City. This study uses a normative-empirical type of research regarding the implementation of normative legal provisions in their actions in every legal event that occurs. The results and research studies show that a child who suffers from kleptomania cannot be convicted unless he commits another crime outside of kleptomania, so he can be punished by diversion based on the applicable law, this is what law enforcement officers in Surakarta City implement when handling cases child crime.
