Abstract

This research is regarding the cancellation of the adoption decision because there is no regulation on the cancellation of child adoption such as child adoption causing disparity in judges' considerations in examining, adjudicating, and deciding on decisions regarding the cancellation of the adoption determination and fulfillment of the theoretical aspects of legal ideals, legal certainty, benefit, and justice of judges in imposing a decision regarding the cancellation of the adoption of a child. The research method uses normative juridical law methods. Then the data obtained for research using qualitative research methods refers to 2 laws and regulations, court decisions, and norms that live and develop in the community. Based on the results of the study, there was a disparity regarding the absolute authority of the District Court to examine, hear, and decide on civil cases of cancellation of adoption decisions in 3 (three) Surabaya District Court Decisions Number 155/Pdt.G/2017/PN.Sby, Kendal District Court Decisions Number 7/Pdt.G/2018/PN.Kdl and Central Java High Court Decision Number 389/Pdt./2018/PT.SMG, and Sragen District Court Decision Number 7/Pdt.G/2020/PN.Sgn. In the aspect of legal ideals, the Surabaya District Court Decision Number 155/Pdt.G/2017/PN.Sby has been based on aspects of certainty, benefit, and justice, the Sragen District Court Decision Number 7/Pdt.G/2020/PN.Sgn. has been based on aspects of certainty and justice but not yet in benefit, and the Kendal District Court Decision Number 7/Pdt.G/2018/PN.Kdl and Central Java High Court Decision Number 389/Pdt./2018/PT.SMG are not based on certainty aspects, expediency, and justice.
