Abstract

From this study, the results obtained are that: First, fake news or hoaxes are fake news and efforts to spread it with the aim of making readers believe the fake news. Social media that are often accessed by the public: Facebook, Twitter, YouTube, Instagram, and others. The forms of information contained in social media are personal data or general information, biodata, photos, videos and so on. The spread of fake news (hoax) circulating on the internet through social media, mass media is a communication tool (means) used by the whole community. UU no. 19 of 2016 regulates what actions are prohibited and the threat of criminal sanctions for anyone who spreads false news (hoax). Second, the legal regulation of spreading hoaxes in the Criminal Code is regulated in Articles 310, 311, 378, 390. Law no. 19 of 2016 concerning Amendments to Law No. 11 of 2008 is regulated by Article 27; Article 28; Article 29. The form of criminal sanctions for spreading false news or hoaxes is regulated in Article 45, Article 45A, Article 45B. Third, the Police investigation process against the perpetrators of the crime of spreading false news (hoax). The investigation is carried out starting with calling the suspect perpetrators who are then processed for examination and summoning related witnesses and expert witnesses and knowing that there has been a criminal act.
