Abstract

The Multipurpose Cooperative (KSU) Astari Girimarto has a financial product, namely deposit funds or commonly referred to as time deposits. Deposit funds are deposits where the funds are deposited only once, but the withdrawal of these funds can only be done within a certain time in accordance with the agreement that has been agreed between the Cooperative and the depositor of funds. This study aims to determine the process of implementing the fund deposit agreement between the Cooperative and the customer, the regulations and the rights and obligations of the parties in implementing the fund deposit agreement at the Astari Girimarto Multipurpose Cooperative (KSU) and the legal responsibility if one of the parties defaults in implementation of the fund deposit agreement at the Multipurpose Cooperative (KSU) Astari Girimarto. This research method is normative because in this case this approach examines legal regulations, legal rules, legal principles in relation to legal liability between the Cooperative and the customer in the fund deposit agreement. The type of research used is descriptive research, which describes in detail and thoroughly the description and systematics of the responsibility of the Cooperative to the depositor of funds at the Multipurpose Cooperative (KSU) Astari Girimarto. Sources of data used are secondary data accompanied by field research in order to obtain primary data. The results obtained are that there are 3 processes in the implementation of the fund deposit agreement, namely prior to the agreement on the deposit fund deposit agreement where the prospective customer must meet administrative requirements, namely having an ID card (Kartu Tanda Sipil) so that the agreement process can be accepted by the cooperative. After the customer is trusted to carry out the agreement, the Cooperative will provide a letter of agreement to the customer to be read and understood and if the customer agrees with the contents of the agreement, the customer can sign the agreement as proof of agreement. In the last process, when the customer has agreed to enter into the agreement, the customer must deposit funds to the customer's teller to store the funds in accordance with the agreed period of time and also the withdrawal is in accordance with the agreement. Therefore, both parties who enter into this deposit fund deposit agreement must carry out their rights and obligations as well as possible and if there is a violation, legal liability will arise. Legal responsibility will arise if one of the parties makes a mistake in the implementation of the agreement and violates the applicable regulations. The error can occur due to default or because of an unlawful act.
