Abstract

One of the human rights regulated in the constitution of the republic of Indonesia is the right to get a decent place to live, but in reality not everyone has a proper place to live, especially for low-income people (MBR). To overcome this, the government made efforts by providing housing ownership assistance which was realized through the implementing bank to then be distributed to MBR in the form of Subsidized Home Ownership Loans (Subsidized Mortgages). Departing from this, this research was conducted with the aim of reviewing juridically regarding the terms and processes as well as the legal relationship of the parties in the Subsidized Mortgage Agreement, especially at PT Bank Tabungan Negara (Persero) Tbk Solo Branch. This study uses a normative approach with a descriptive type of research that provides a comprehensive and systematic description of the terms and processes as well as the legal relationship of the parties in the mortgage agreement/subsidized flats at PT Bank Tabungan Negara (Persero) Tbk Solo Branch. The sources of data in this study are secondary data and primary data obtained through library research and field studies which are then analyzed using qualitative methods. The results of this study indicate that the terms and processes as well as the legal relationship of the parties in the loan agreement for subsidized housing/flat ownership at PT Bank Tabungan Negara (Persero) Tbk Solo Branch are in accordance with the provisions of Article 11 of the Regulation of the Minister of PUPR RI Number 20/PRT/M /2019 Concerning the Ease and Assistance of Home Ownership for Low-Income Communities and Article 8 of Law Number 10 of 1998 concerning Banking, as well as Article 1338 paragraphs (1), (2), (3) of the Civil Code.
