Abstract

One way to develop a business is franchise method. Franchising or commonly referred to as a franchise is part of the propriety of business partners against the main rules given by the business owner (franchisor). Franchising is essentially a marketing concept for rapid network expansion. The purpose of this research is to help someone who wants to be involved in franchising to understand the stages to be able to use a trade name in Francis officially, as well as to add insight into new franchisees what are the legal consequences that occur when using a trade name without cooperation with the franchise owner (franchise owner). . This research method is normative-empirical in which legal research concerning the application of normative legal provisions (in this case a cooperation contract) and the application of empirical law is carried out with field studies related to the applicable legal rules. The type of research used is to describe or explain possible data sets about the current state of the study. The type of data used is primary data obtained from primary legal materials as well as direct information during interviews and secondary data obtained from documents that can explain primary legal materials. The results showed that to get a trade name, especially in Cuan Boba, located in Sukoharjo, through provisions ranging from obtaining related information pamphlets, approval of package selection, to agreement on cooperation contracts between the parties, both from the franchisee and the franchisee owner. And better understand the binding rules that the franchisee must not do if he has agreed to do this franchise cooperation.
