Abstract
Financial Technology Peer to peer lending (Fintech P2P Lending) is a service that can bring together lenders and prospective loan recipients on the same platform. Along with the times, this service is used by the Indonesian people to carry out economic activities that will have an impact on the welfare of their respective economic sectors. The purpose of this study is to determine the extent of knowledge of the Indonesian people, especially the younger generation about peer to peer lending and whether this economic activity is in accordance with the rules, both in the perspective of positive law and Islamic law. The research method used is juridical-empirical. Primary data was obtained by giving online questionnaires to 51 students of FH UMS class 2018. As a result, respondents only knew about peer to peer lending activities in general, but they did not know the legal system in it. So it can be concluded that the legal knowledge of the implementation of peer to peer lending in Indonesia is still weak. The risk of invested capital and borrowed debt can only be understood by the respective service users who want to know these regulations. Meanwhile, from a legal perspective, legal regulations regarding peer to peer lending in Indonesia have not produced strong legal certainty because they are regulated in various different rules. So, it should be reconsidered to make and issue special regulations regarding peer to peer lending that meet the criteria of positive law and Islamic law in Indonesia so that legal certainty can be guaranteed. The hope is that the community will be more protected when carrying out activities, both investing their money and borrowing money in order to succeed in the goal of fintech procurement, namely increasing the economic welfare of the Indonesian people.
