Abstract

Outsourcing workers are workers who have a working relationship with a provider of outsourcing services with work placements in the work area of companies that use outsourcing services that have previously tied themselves to work relationships between companies providing outsourcing services and companies using outsourcing services. This study aims to find out the legal construction of the outsourcing system work agreement between outsourcing workers and outsourcing service provider companies at PT. Makmur Jaya Sragen, knows the suitability between the outsourcing system work agreement between the outsourcing worker and the outsourcing service company at PT. Makmur Jaya Sragen with the rules contained in the Manpower Act and knows the legal responsibility if the outsourcing agreement is violated by one of the parties. This study uses a doctrinal or normative approach, because in this study the legal principles, legal principles, legal aspects were examined in the outsourcing system work agreement at PT. Makmur Jaya Sragen. This type of descriptive research is because to describe or explain data as thoroughly as possible about legal construction in a work agreement with an outsourcing system between outsourcing workers and service providers in this case PT. Makmur Jaya Sragen. The results of the research show that the outsourcing system work agreement between outsourcing service providers and outsourcing workers at PT. Makmur Jaya Sragen is not in accordance with article 59, article 66 paragraph (1), article 66 paragraph (2) letter b and article 66 paragraph (4) of Law Number 13 of 2003 concerning Manpower. Outsourcing System Work Agreement between Outsourcing Workers and Outsourcing Service Providers at PT. Makmur Jaya Sragen is made in writing in the form of a Specific Time Work Agreement made by an outsourcing service provider company in the form of a standard agreement and approved by both parties, namely the provider of outsourcing services and the outsourced workers in the form of an agreement deed signed by both parties namely the provider of outsourcing services and outsourcing workers. In the agreement between outsourcing workers and PT. Makmur Jaya Sragen, If one party carries out a default or commits an offense, the party causing the loss must be accountable to the aggrieved party with compensation.
