Abstract

Employment agreements result in a working relationship between workers / employers and employers or employers, occurring after an agreement has been made by the worker with the employer, where the worker declares his ability to employ workers by paying wages. Regulated in Law No. 13 of 2003 concerning Manpower. With the existence of contract labor through the PKWT system, it causes problems in its implementation. One of them has implications for the fulfillment of contract labor rights that are often ignored by employers. In this study, researchers will examine the legal protection for certain time workers for workers in the agreement at PT.Prakarsa Purna Mandiri Jakarta. In the statutory regulations, the Work Agreement for a Specific Time has been regulated in Article 86 of Act Number 13 of 2003 concerning Manpower. The practice of implementing PKWT has a lot of irregularities from the company, especially in fulfilling legal protection for temporary workers or contract workers who should meet the criteria mentioned in the legislation as a legal basis. This problem is not taken seriously by entrepreneurs, this is evidence that the law can be defeated by economic interests. The purpose of this paper is to describe the construction of legal relations between workers for certain time workers with PT. Purna Mandiri Jakarta Foundation and to describe the legal protection for workers in the agreement with PT.Prakarsa Purna Mandiri Jakarta. In this study the author uses a normative doctrinal approach. Because, the approach taken is the legislative approach, the concept approach, and the comparison approach. The author will conduct research whether the agreement related to a specific time agreement with the relevant Party is in accordance with the legislation and doctrine.
