Abstract
Indonesian people who are Muslims should distribute inheritance in accordance with Islamic inheritance law. However, in practice there are still people who divide their inheritance that isn’t fit with Islamic inheritance law, one of them is through an Inheritance Agreement. An Inheritance Agreement is an agreement made by the heirs to define the allocation of inheritance. The Inheritance Agreement is considered the right solution in the distribution of inheritance because in its determination it has been agreed by the heirs who concerned, but in practice there are still inheritance disputes even though the distribution has been carried out through the Inheritance Agreement. The purpose of this research is to find out the position of the Inheritance Agreement based on Decision Number 0219/Pdt.G/2024/PA. Klt and Decision Number 3536/Pdt.G/2023/PA. JS. This research was conducted using normative juridical methods through a case approach. The result of this research is the position of the Inheritance Agreement based on the court decision above is declared valid according to law as long as it doesn’t contradict the Article 1320 and Article 1337 of Civil Code and pays attention to the principles of legal certainty, utility, and justice. So the parties to the dispute are obliged to carry out the Inheritance Agreement that has been made.
