Abstract

This study aims to find out the application of restorative justice as an attempt to settle the law against criminal acts of theft according to the perspectives of Islamic criminal law and positive criminal law as well as the constraints faced by the police at the time of application of restorative justice. This study uses an empirical juridical approach with the main data source being primary data in the form of interviews with parties involved in the application of restorative justice criminal theft, in addition to using secondary data sources in books and journals. The nature of this study is descriptive analysis with a qualitative approach. Data collection techniques through interviews and library studies. The analysis of the data was conducted by examining the data obtained, then described in narrative form, then the data were linked to the theory of legislation to obtain answers to the problems in this study. From this study, it was obtained that the application of restorative justice to criminal theft in the Laweyan Sector Police area is an alternative way to settle the law so that it can be resolved familially between the perpetrator and the victim. Regarding the application of restorative justice to theft crimes in the Laweyan Sector Police area, it has been implemented as it should based on the existing guidelines, but there are still several obstacles to implementation. So that there is a need to implement legal socialization to the community related to restorative justice so that the obstacles faced can be resolved.
