Abstract
Buying and selling is a term that can be used to refer to two sides of a transaction that occurs at once, namely buying and selling. Apart from being farmers, other professions that some residents of Wareng village are engaged in vary according to the expertise they have, one of which is related to the craft of processing agate. There is a speculative system in the practice of buying and selling pieces of agate. Where the seller and the buyer estimate the chunks of stone that can be processed. Based on these problems, the author wants to examine whether the buying and selling of agate chunks that occurred in Wareng Village, Punung District, Pacitan Regency, was in accordance with Islamic law. The research objectives in the problems to be studied are as follows: To determine the suitability of the practice of buying and selling agate in the form of chunks in Wareng Village, Punung District, Pacitan Regency in terms of Islamic law. This research is a field research. This research was conducted to examine the problems related to the sale and purchase of agate in the form of chunks in Wareng Village, Punung District, Pacitan Regency. This study uses a normative descriptive approach. Sources of data used are primary and secondary. Primary data were obtained from interviews with agate sellers and craftsmen in Wareng Village, Punung District, Pacitan Regency. While secondary data is obtained through intermediary media or indirectly in the form of journals, previous theses and books related to buying and selling agate in the form of chunks. The results of the study prove the practice of buying and selling agate in the form of chunks of stone in Wareng Village, Punung District, Pacitan Regency when viewed from Islamic law, between sellers and buyers in buying and selling stone chunks have made mutually agreed agreements. If the stones being traded cannot be processed, both of them agree not to return the lumps of stone and the money. In this case, there has been mutual pleasure between the seller and the buyer. The form of buying and selling agate chunks relies on speculation so that it is included in Gharar whose position is between the forgiven and the unforgivable because when making a sale and purchase transaction for agate chunks there is a stone skin that covers it so you can't see clearly the stone that can be processed and only guesses.
