Abstract

The number of marriages during the Covid-19 pandemic has increased, both marriages committed by couples who are old enough or couples who are not old enough. Couples who are Muslim and are not old enough apply for a marriage dispensation to the Religious Courts as a form of permitting marriage for a couple or one of the partners who are still not old enough, that is, have not yet reached the age of 19 years. The increase in requests for dispensation for marriage during the Covid-19 pandemic was motivated by the change in the determination of the minimum age limit for marriage in Article 7 of Law Number 16 of 2019 Amendments to Law Number 1 of 1974 concerning Marriage, the existence of new regulations regarding the marriage system. the submission of an amended application according to Article 8 of the Regulation of the Supreme Court of the Republic of Indonesia Number 5 of 2019 concerning Guidelines for Adjudicating Applications for Marriage Dispensation, and several other factors due to the impact of the Covid-19 pandemic which was followed by many applications for marriage dispensation on the grounds that the prospective bride was already pregnant. The number of applications that go to the Religious Courts, especially the Surakarta Religious Courts, is increasing. The dispensation granted by the Surakarta Religious Court to the applicant is a form of final solution given by the Religious Court as an effort to deal with the prevention of adultery in order to prioritize the benefit if the marriage must be carried out immediately. Because basically the prevention of marriage dispensation can be done through several sources, such as from oneself, family, counseling from the government and several other sources in which can increase knowledge about marriage.
