Abstract
Hudud as one of the Islamic laws contained in the Koran needs to be explored so that clear information is obtained. By examining this hadd adultery, “a non-comprehensive understanding of the hadd of adultery in Islam will be avoided.” The practice of adultery can bring crucial problems in social life, among the problems caused by this heinous act are related to the status of children and marrying a woman as one of the perpetrators. This study aims to find out how the provisions of hadd adultery according to Muhammad Ali As}-S}abuni in the interpretation of Rawa>i’ Al-Baya>n fi> Tafsi>r A>ya>t Ah}ka>m min Al-Qura>n QS An-Nu>r verses 1-3. The data analysis technique used is descriptive analysis method, which is a method by describing and analyzing which has the aim of describing information as it is according to the variables studied, so that there is an attempt to describe, record, analyze, and interpret it based on the data. The conclusion of this study is the provisions of hadd adultery according to Ali As}-S}abuni, namely: the punishment for unmarried adulterers is lashed 100 times and exiled for one year, both male and female adulterers. However, the exile of female adulterers must be accompanied by a mahram. And the punishment for those who are married is stoning. Those authorized to carry out the execution of the punishment for adultery are the leader and a master or master who has servants or slaves. The quality of the lashes and “technically for the adulterer” is a blow that is “medium” not heavy and “not light, nor is it light, the punch is aimed ‘to cause ‘pain’, not to ‘eliminate ‘life’. Being hit by an adulterer is the back. The prohibition of giving help “to people who are punished” because the punishment is aimed “to educate and deter and encourage “attending and witnessing the punishment” for a group of believers has the aim “to serve as a lesson, a warning, and an example.”
