Abstract
Humans are made up of men and women who have the nature to live together in pairs. This age limit is important in state law related to marriage in order to create public benefit. The Qur'an does not provide a minimum age limit for marriage, only an indicator of worthy of marriage. Indonesia and Malaysia are countries that include formalizing the age limit into state law. This study aims to compare the regulations regarding the limitation of the age of marriage in two places, namely Indonesia (Law No. 16 of 2019) and Sarawak (Ordinant 43 Islamic Families of the State of Sarawak of 2001) so that conclusions are obtained in the form of similarities and differences that exist in the two marriage regulations. the. The research method used in this paper is normative research which is called the data collection carried out by literature study. The age limit for marriage between Indonesia and Sarawak has three similarities, namely it does not conflict with Islamic law, has absolute male and female elements and contains the principle of maturity. The difference in the provisions of the Law is related to the background and concept of age restrictions for men and women.
