Abstract

The goals of this studi is to know and understand the settlement of default in Islamic banking in case number 1449/Pdt.G/2018/PA.klt and case number 1135/Pdt.G/2018/PA.Klt in the Klaten Religious Court. And, to find out and understand the comparison of the legal liability for default in sharia banking cases between case number 1449/Pdt.G/2018/PA.Klt and Case Number 1135/Pdt.G/2018/PA.Klt. Research methods put on a normative juridical approaches that are descriptive properties. Data source consists from secondary data, namely primary and secondary law sources. The methods of data collection with literature study and the data were analyzed qualitatively. The results showed that there are several comparisons between the settlement of wanprestasi in the peace deed and the court's decision. The comparison indicator is about the final agreement produced. The final agreement produced through peace will result in a peace deed agreed by both sides, so that the agreement is fair and balanced. With a balanced deed, the parties can be responsible for implementing the agreement. Meanwhile, the final agreement produced through the trial will result in a verdict that is decided by the judge. So, the parties must carry out the judge's decision.
