Abstract

The COVID-19 pandemic has hit the world, especially Indonesia, for almost two years. This condition causes problems both in the health sector and the economy. The economic activity of the community has been hampered due to the increasing spread of the Covid-19 virus. As an effort to contain the spread of the COVID-19 virus in Indonesia and maintain a balance between the health sector and the economy, the government has set a policy of implementing restrictions on community activities (PPKM) as outlined in the instructions of the minister of home affairs. In accordance with the mandate of the 1945 Constitution, the state in making policies is obliged to provide social welfare for citizens, including during the COVID-19 pandemic. The purpose of this study is to determine the implementation of PPKM policies that have been implemented in Indonesia during the COVID-19 pandemic and to provide an overview of PPKM policies that are oriented towards social welfare (welfare society). This research method uses normative juridical research methods with primary library sources, namely laws and regulations related to PPKM policies and the concept of social welfare (welfare society), as well as secondary library sources, namely books, articles and journals related to PPKM policies and social welfare (welfare society). Based on this research, the results show that the PPKM policies that have been implemented by the government still do not guarantee a balance between the health and the economy of the community. The PPKM policy, which often changes terms and the legal basis is not strong, has resulted in the implementation in the community regarding the imposition of sanctions and the fulfillment of government obligations that have not been given fairly. So that the current PPKM policy has not implemented the concept of social welfare (Welfare society). PPKM policies based on social welfare can be implemented if their implementation refers to the provisions of the applicable laws, namely the law on health quarantine, the law on the formation of legislation and the law on social welfare.
