Abstract

The Build Operate Transfer (BOT) agreement between the Regional Government and the Private Party is an equal legal relationship, which will give rise to rights and obligations for each party as a legal consequence of the agreement they make. This study aims to determine how the construction of legal relations in the public port reclamation agreement between PT. Rembang Bangkit Sejahtera Jaya (RBSJ) with PT. Amir Hajar Kilsi and how is the legal protection for the parties involved in the public port reclamation agreement between PT. Rembang Bangkit Prosperous Jaya with PT. Amir Hajar Kilsi. This study uses a Doctrinal (Normative) approach. Using this type of descriptive research. The results showed that the construction of legal relations in the public port reclamation agreement between PT. Rembang Bangkit Prosperous Jaya with PT. Amir Hajar Kilsi, is a Build Operate Transfer (BOT) agreement, because the agreement is about legal subjects, legal objects and the main rights and obligations of the parties in the agreement in accordance with Article 103 of the Minister of Finance Number 78/PMK.06/2014 concerning Procedures for Goods Registration State Owned; pasa; 104 Permenkeu Number 78/PMK.06/2014 concerning Procedures for Utilization of State Property; Article 3 Decree of the Minister of State Finance of the Republic of Indonesia Number: 248/KMK/04/1995 and the opinion of R. Subekti.
