Abstract

Delivery of goods that results in two parties having a legal relationship, namely the delivery party and the Rosalia Express party whose agreement is called a reciprocal agreement, because between the Rosalia Express Party and the delivery party, it creates obligations for each party. And if both parties do not carry out their rights and obligations in full, it will lead to legal responsibility. Therefore, the purpose of this research is to find out the implementation of the goods delivery agreement process, to know the regulations related to the rights, obligations and legal responsibilities of the shipper with Rosalia Eksprees and to know how the legal responsibility is if the two parties default or act against the law. In this study, the author uses a normative approach research method that explores the rules of law, legal norms, legal principles which are all related to legal responsibilities between Rosalia Express and the Shipper. The type of research used in this research is descriptive research that clearly describes the legal responsibilities between the sending party and Rosalia Express in the process of implementing the delivery of goods. The results of this study indicate that in the process of implementing the goods delivery agreement. Prior to the agreement, the delivery party and the Rosalia Express party must meet administrative and legal requirements. At the time of the agreement, it is marked by the signing of the Letter of Delivery (SP) or the receipt of the delivery of goods that has been made by Rosalia Express based on the standard agreement that was previously made by Rosalia Express. After the agreement, a binding legal relationship arises and gives birth to rights and obligations. Right of the consignor of goods: submit a claim in the event of damage to the delivered goods, ensure that the shipment remains intact until its destination, obtain information on the progress of the goods sent, the goods sent to the destination based on the agreed time and in intact condition. Responsibilities of the shipper: pay the cost of shipping goods according to the service chosen, pack the shipment to protect the contents of the goods, include complete information about the goods to be sent. Rosalia Express's rights: receive postage payments from the consignor of goods, get clear and detailed information about the shipment, refuse goods to be sent if the goods are included in the category of dangerous goods, refuse to submit a claim if it exceeds the predetermined time limit, namely 1 x 24 hours. Rosalia Express's obligations: offer insurance to each party who sends goods, carry out and complete the delivery of goods according to the service that has arrived safely and intact to the destination, during the process of shipping Rosalia Express is obliged to take care of the shipment. If in the delivery of goods one of the parties does not fulfill its rights and obligations, then it must be responsible on the basis of default in accordance with Article 1237 of the Civil Code and if one of the parties violates the applicable regulations, it can be accounted for based on unlawful acts in accordance with Article 1365 of the Civil Code.
