Abstract
People's Business Credit (KUR) is a financing program aimed at Micro, Small and Medium Enterprises and Cooperatives (UMKM-K) in the form of providing working capital and investing in productive businesses that are being run by business actors. This program is a government design, but in its implementation the source of funds comes from bank funds. Therefore, the implementation of this credit involves two parties, namely between PT Bank Rakyat Indonesia and the Customer. This credit provision is based on an agreement that has been agreed upon by both parties. Which if one of the parties does not fulfill their rights and obligations in accordance with what was agreed upon, it will lead to legal liability. This study aims to determine the process of providing People's Business Credit, regulations and rights and obligations between the Bank and the Customer and the legal responsibilities that arise if an error occurs. The method used in this study is a normative approach that will examine the legal rules relating to the granting of credit to PT Bank Rakyat Indonesia. The type of research used in compiling this research is descriptive research, which explains the overall picture related to legal responsibility for the provision of People's Business Credit. The results of this research show that the process of granting People's Business Credit contains 3 stages, namely: (1) Prior to the occurrence of an agreement between PT Bank Rakyat Indonesia and the Customer, it must meet the administrative and legal requirements as stipulated in Article 1320 of the Criminal Code, (2) At the time of occurrence the agreement is marked by the signing by both parties of the Debt Acknowledgment Letter that has been made unilaterally by PT Bank Rakyat Indonesia (standard agreement), (3) After the signing occurs, there is also an agreement between the two parties, which creates a legal relationship and give rise to rights and obligations that must be fulfilled by both parties. If in its implementation there are parties who do not carry out according to the applicable agreement, they can be accounted for based on Default, if one of the parties violates the applicable regulations, they can be held accountable based on Unlawful Acts.
