Abstract

This study aims to determine the form and content of the cooperation agreement between PT Kebakkramat Elang Perkasa and Building Material Shops, the Agreement is an act whereby one or more parties bind themselves to one or more people (Article 1313 of the Civil Code) and know the legal relationship between PT Kebakkramat Elang Perkasa and Building Materials Shops. The method of approach is normative juridical, the type of research used is descriptive research, while the types of data in this study consist of primary, secondary and tertiary data. The primary data of the researcher was obtained from the private deed of the cooperation agreement between PT Kebakkramat Elang Perkasa and the building material shops, the secondary data was obtained from the literature study and the tertiary data was obtained from the legal dictionary and encyclopedia with qualitative analysis. The results of the research and discussion show that, firstly, the form and content of the cooperation agreement between PT Kebakkramat Elang Perkasa and Building Material Shops is in accordance with article 1338 of the Civil Code concerning the Principle of Freedom of Contract and has fulfilled the terms of the agreement with the provisions of article 1320 of the Civil Code, secondly the legal relationship between PT Kebakkramat Elang Perkasa and Building Material shops that give rise to the rights and obligations of the parties who have good faith in accordance with Article 1338 paragraph (3) of the Civil Code.
