Abstract

The development of a corporation in Indonesia in addition to having a positive impact on economic growth also has a negative impact in the form of corporate crime which is very detrimental to society and the state. Corporate crime is considered as the main factor triggering conflict between corporations and society and the state because in their activities corporations do not care about environmental sustainability, but only focus on seeking maximum profit. Based on the principle of absolute responsibility (strict liability), the corporation is obliged to provide compensation to the community due to the impact of the activities it causes. In addition, the state can impose criminal sanctions on corporations in the form of an obligation to carry out environmental rehabilitation. However, this obligation has not been fully implemented by corporations because environmental rehabilitation efforts require a very long time and very large costs, besides the obligation to provide compensation to the community is a priority that must be carried out before carrying out environmental rehabilitation.
