Abstract
Efforts to build housing and settlements as decent housing are continuously improved to provide an increasing number of housing and at affordable prices with decent quality for habitation, especially for groups of people who cannot buy houses in cash, they will buy houses on credit through the Institution banking finance by applying for a Home Ownership Credit (KPR). One of the banks that provide Home Ownership Loans (KPR) is PT. Bank Mandiri, Tbk Kudus Branch Office. Home Ownership Loans are loans given by Bank Mandiri to people who want to buy or housing units that have been provided by the Housing Company by way of credit. Credit provided by banks is based on trust, so by offering credit is giving trust to customers. However, it is not easy to know for sure whether the person applying for the mortgage is a trustworthy person. Various risks in providing credit can prevent bad credit when it comes to repayment, resulting in bad credit. Based on this, the bank as the creditor must be able to apply the precautionary principle by conducting credit analysis in approving a submitted credit application. The mortgage agreement is made based on Articles 1320,1333, 1334, 1335, 1337 and Article 1338 Paragraph (1) of the Civil Code, Banking Law, and Financial Services Authority Regulations.
