Abstract

Inheritance law is a set of legal rules that regulate the transfer of rights to inherited goods belonging to people who have died (heirs) to living people who are left by the heirs who are called heirs. The diversity that exists in Indonesia is influenced by a pattern of social interaction from each group or level of society, it can be seen from the three inheritance systems that none of them are seen directly directed at a certain form of community structure, which is related to inheritance applies and can be found in various forms and structures of society in the form of one community structure that can be found in more than one existing inheritance system. The approach method used in this research is the juridical-normative research method, which refers to the legal norms contained in laws and regulations and court decisions as well as norms that live and develop in society. The type of research used in this research is descriptive analytical, namely the method used to describe a condition or situation that is currently happening in relation to legal theories that are the object of research, such as relating to inheritance distribution according to civil law and Islamic law. In this study, we will discuss how the legal review of the distribution of inheritance in Chinese Muslims according to Islamic Law, Civil Law, and Chinese Customary Law and discuss how the distribution of inheritance if there are religious differences in an inheritance.
